Biden’s Tyrannical Vaccine Mandate Stayed Again

Today, Education and Labor Committee Republican Leader Virginia Foxx (R-NC) issued the following statement after the Supreme Court reinstated the stay of the Occupational Safety and Health Administration’s (OSHA) COVID-19 vaccination-and-testing mandate:
 
“President Biden’s authoritarian and unlawful vaccine mandate is the last thing our job creators and workers need. Making businesses choose between firing loyal workers or being fined out of existence is unconscionable, especially during a worker shortage.
 
“The administration’s actions have been authoritarian and have ignored the Constitution’s separation of powers. By issuing the vaccination-and-testing mandate, OSHA blatantly disregarded the law and grossly overstepped its authority.
 
“The Biden administration must stop weaponizing the federal bureaucracy against businesses and workers and instead get Americans back to work. Intimidating the American people into submission is antithetical to self-government and individual rights.”
 
Background: On December 17, 2021, the U.S. Court of Appeals for the Sixth Circuit lifted the Fifth Circuit’s stay of the Biden administration’s vaccine mandate. The Supreme Court heard oral arguments on January 7 on whether to reinstate the stay. Republican Leader Foxx, Rep. Rick Allen (R-GA), Rep. Elise Stefanik (R-NY), Rep. Jim Banks (R-IN), and Senator Mike Braun (R-IN) led 136 Representatives and 47 Senators in submitting an amicus brief to the Supreme Court expressing strong opposition to OSHA’s authoritarian vaccination-and-testing diktat.
